May 2004: FDA Approves DHA Nutrition Claims

DHA Nutrient Content Claim (NCC)
The U.S. Food and Drug Administration (FDA), allowed a petition to permit food manufacturers to make nutrient content claims for omega-3’s in food products to become law. This new law establishes a Daily Value (DV) for short chain and long chain omega-3 fatty acids. The claims, which will be used in labeling conventional foods and dietary supplements containing a qualifying level of a nutrient, are based on authoritative statements in the IOM Macronutrients Report. A level for each nutrient has been identified and has been translated into a population-weighted value in accordance with a calculation recommended in the IOM Guiding Principles Report.
For product to claim a high, rich in or excellent source content of DHA or EPA omega-3, the product must contain 130 mg or more DHA/EPA per Reference Amount Customarily Consumed (RACC). For ALA omega-3, claims of high, rich in or excellent source content will characterize products containing 260 mg or more of ALA per RACC.
“Good source”-type claims are not proposed or approved for DHA/EPA content. For ALA, “good source”-type claims will characterize products containing 130 mg or more of ALA per RACC.
“More”-type claims are not proposed or approved for DHA/EPA content. For ALA, “more”-type claims will characterize products containing at least 130 mg or more ALA per RACC than an appropriate reference food.
